What is VeriFactu?

It does not require direct changes in companies or freelancers, but establishes that the invoicing programs used by them must be approved and comply with strict technical requirements.

    • Inalterability: Invoices must be unmodifiable after issuance, guaranteeing their authenticity.
    • Traceability: Each invoice must be linked to a system that allows tracking its origin and associated events.
    • Remittance capability: Even if real-time remittance is not required, invoicing programs must be prepared to remit invoices to the tax authorities if requested to do so.
    • Secure storage: Invoices should be stored in conditions that allow access at any time.
    • Technical compliance: Billing systems must be adapted to the specifications of Order HAC/1177/2024 in order to be approved.

    Who is required to comply with VeriFactu?

    All electronic invoicing programs in Spain must be adapted to the VeriFactu regulations, regardless of whether the companies or self-employed that use them decide to send their invoices regularly to the tax authorities.

    This mainly affects:

    • Companies and self-employed with an annual turnover of less than 6 million euros.
    • Entities not included in the SII.

    It will not be applied in the foral territories (such as the Basque Country and Navarre), which have their own tax management systems. In addition, companies that are already under the Immediate Information System (SII) are excluded, as they already comply with other regulatory requirements.

    • Entrepreneurs and professionals issuing invoices who are affected by the regulation must have their computerized invoicing systems (SIF) adapted to the characteristics and requirements established in the regulation and in its implementing regulations before July 1, 2025.
    • The producers and marketers of those RIS to which the regulation applies, in relation to their production and marketing activities of such RIS, must offer their products fully adapted to the regulation within a maximum period of nine months from the entry into force of the ministerial order that develops the technical specifications of the requirements imposed on RIS. However, in relation to RIS included in multi-year maintenance contracts contracted before the latter deadline, they must be adapted to the contents of the regulation before July 1, 2025.

        • Reference to VeriFactu: Invoices shall include the explicit mention of having been generated through a verifiable issuing system with the expression “Veri*Factu”.
        • Ability to send to the Tax Agency: VeriFactu invoices must be able to be sent electronically to the Tax Agency in XML format.
        • Event log: In addition, a detailed record of each invoice and associated events (issuance, modification, etc.) should be maintained.

        Failure to use approved billing software can have serious consequences:

        • Fines of up to 50,000 euros: Using an uncertified invoicing program can lead to penalties of up to 50,000 euros for each fiscal year.
        • Penalties for tampering: Altering or modifying certified software also carries fines of up to 50,000 euros.
        • Operational difficulties: The lack of an approved system can complicate the submission of invoices to the tax authorities in the event of a request.
        • Loss of trust: Failure to comply with tax regulations can affect relationships with customers and business partners.
